l Ryan Gamble (Gee) was cited for striking Nick Dal Santo (StK) in Q2. The incident was judged as intentional, low impact and high contact. Gamble was offered a one match suspension with an early plea. The player accepted guilt and the MRP judgement.

NORTH MELB v MELBOURNE
Brad Miller (Mel) was cited for rough conduct against Daniel Pratt (NM). Even with an early plea a one-match suspension from his prior record was inevitable. Miller accepted guilt and the MRP judgement of suspension for one match.

SYDNEY v WEST COAST
Barry Hall (Syd) was cited for striking Brent Staker (WCE) in the first quarter. The MRP viewed the incident as intentional, high contact, causing severe impact. The matter was referred to the AFL Tribunal. Hall pleaded guilty at the Tribunal on Tuesday night where the player was suspended for seven matches. Hall also carries 790 demerit points, effectively another match for the next year in carry-over points should he re-offend.

CARLTON v COLLINGWOOD
Nick Maxwell (Col) was cited for intentionally striking Marc Murphy (Car) in Q1. The incident drew a three-match suspension, reduced to two by the 25 per cent good behaviour discount and ending as one game with an early plea. The player accepted guilt and the MRP suspension of one match.

FREMANTLE v RICHMOND
Stephen Dodd (Fre) was cited for tripping Jack Riewoldt (Rch). The MRP offered Dodd a one-match suspension with an early plea. Fremantle sought the adjudication of the Tribunal. On Tuesday night the Tribunal downgraded its guilty verdict to a reprimand.

Leigh Montagna (StK) and Andrew Lovett (Ess) were cited for wrestling each other during the three quarter-time break. The players admitted guilt and accepted the MRP imposition of $900 fines upon both.

COLLINGWOOD v NORTH MELBOURNE
Daniel Pratt (NM) charged with a Level Two rough conduct offence against Josh Fraser in Q1. The MRP offered Pratt a one-match suspension with an early plea. North Melbourne sought the adjudication of the Tribunal. On Tuesday an effort to have the charge downgraded from minimal to low was unsuccessful. Pratt was suspended for one match.

MELBOURNE v CARLTON
Matthew Whelan (Mel) was cited for striking Brendan Fevola (Car) during Q3. The MRP offered Whelan a one-match suspension with an early plea. The player admitted guilt and accepted the MRP suspension.

WEST COAST v PORT ADELAIDE
Chad Fletcher (WCE) was cited for making negligent contact with umpire Hayden Ryan in Q3. The MRP imposed a fine of $1,950 on Fletcher. The player admitted guilt and accepted the fine imposed by the MRP.

ESSENDON v PORT ADELAIDE
l Adam McPhee (Ess) by umpire Martin Ellis for unduly rough play in Q4 against Travis Boak (PA). The MRP charged McPhee with a Level One offence of making front-on forceful contract against Boak. He was offered a one-match suspension with an early plea. Essendon sought the adjudication of the Tribunal. On Tuesday night McPhee pleaded not guilty to negligently making front-on contact. The Tribunal deliberated and found McPhee guilty of the offence and suspended him for one match. McPhee has 34.34 penalty points added to his record should he re-offend within 12 months.
l Nathan Lovett-Murray (Ess) was cited by the MRP for striking Daniel Motlop (PA). He was offered a one-match suspension with an early plea. Essendon sought the adjudication of the Tribunal. At the Tribunal Lovett-Murray pleaded guilty to striking Motlop but sought to have the charge downgraded from intentional to reckless. The Tribunal deliberated and found Lovett-Murray guilty of the offence and suspended him for one match. Lovett-Murray has 62.5 penalty points added to his record should he re-offend within 12 months.

ROUND 8
HAWTHORN v PORT ADELAIDE
l Ben McGlynn (Haw) cited by the MRP for rough conduct against Kane Cornes (PA) in Q1. The MRP judged McGlynn guilty of a reckless Level Three charge when he ran straight he ran straight at Cornes and made high contact as the Port player player was on his knees trying to pick up the ball. An early plea would draw a three-match suspension. Port Adelaide sought the adjudication of the Tribunal. On Tuesday, the Tribunal supported the MRP assessment and added an additional suspension of one match as McGlynn had failed his challenge and because of 93.75 carry-over points from a reprimand earlier this season. McGlynn was suspended a total of four matches.
l Shaun Burgoyne (PA) cited by the MRP for rough conduct against Sam Mitchell (Haw) in Q1. The MRP judged Burgoyne guilty of a reckless Level Three charge. An early plea would suspend the player for two game. Port Adelaide sought the adjudication of the Tribunal. On Tuesday, the Tribunal downgraded the charge by dropping the level of impact from high to medium. But Burgoyne's 93.75 carry-over points from an offence last year increased his suspension back to three matches.
l Shane Crawford (Haw) was cited for striking Dean Brogan (PA) in an off-the-ball incident in Q1. Crawford admitted guilt and accepted the MRP one-match suspension.

Kyle Reimers (Ess) was fined $1,950 for making negligent contact with an umpire.

l Jarrad Waite (Car) was cited by the MRP with a Level One striking charge against Chris Mayne (Fre) in Q4. While the incident drew only 80 points, 97.75 carry-over points boosts his tally to 173.75, meaning a one-match ban with an early plea. Carlton sought the adjudication of the Tribunal. Waite unsuccessfully argued his case on Tuesday when the Tribunal found the action negligent and suspended Waite for one match.

ADELAIDE v ESSENDON
Brett Burton (Ade) was cited for making forceful front-on contact against Henry Slattery (Ess) in Q1. The MRP assessed the incident as reckless, of low impact and high contact. Burton was issued with a two-match suspension with an early plea. The player admitted guilt and accepted the MRP penalty.

COLLINGWOOD v WEST COAST
Beau Waters (WCE) was cited for engaging in rough conduct against Shane O'Bree (Col) in Q4. Water's contact was assessed as negligent, medium impact and high, however his bad recent record increased the level to 270 demerit points and a two-match suspension with an early plea. West Coast sought the adjudication of the Tribunal. On Tuesday night the Tribunal was satisfied with the MRP assessment and Waters was suspended for two matches.

HAWTHORN v WEST.B'DOGS
Robert Murphy (WB) reported by umpire Stephen McBurney for engaging in rough conduct against Xavier Ellis (Haw) in Q2. The MRP assessed Murphy's contact as negligent, medium impact and high, drawing 225 demerit points and a one-match suspension with an early plea based on his good record and a point reduction to 168.75 points. The player admitted guilt and accepted the MRP penalty.

l Adam Selwood (WCE) was cited for striking Amon Buchanan (Syd) in Q4. In light of his existing good record the MRP offered Selwood with an early plea a reprimand and 93.75 demerit points. West Coast sought the adjudication of the Tribunal. The Tribunal found that Selwood had delivered a blow that made more than negligible contact and reaffirmed the MRP's reprimand against Selwood.

BRISBANE v FREMANTLE
Heath Black (Fre) was cited with a level four striking offence against Troy Selwood (Bri) in Q2. The MRP assessed the incident as intentional conduct (3 points), medium impact (2 points) and high contact (1 point), drawing 325 demerit points and a three-match suspension. With no existing record Black accepted the MRP's early plea offer of a two-match suspension and a reduction to 243.75 demerit points carried over.

MELBOURNE v COLLINGWOOD
l Travis Cloke (Col) was cited for headbutting Matthew Warnock (Mel) in Q2. The level two misconduct charge was assessed as reckless, low impact and high contact. The points were reduced to 93.75 and a reprimand when Cloke was offered an early plea. Cloke admitted guilt and accepted the MRP reprimand.

l Daniel Pratt (NM) was cited with a first offence for wrestling Ryan Crowley (Fre) in Q3. The MRP early plea offer carried a 25 per cent reduction to a $900 fine. Pratt admitted guilty and accepted the MRP fine.
l Ryan Crowley (Fre) was cited with a second offence for wrestling Daniel Pratt (NM) in Q3. The MRP early plea carried a 25 per cent reduction from a $2400 fine to $1800. Crowley admitted guilt and accepted the MRP fine.
l Adam Simpson (NM) was cited with a Level Two offence against Ryan Crowley (Fre) in Q3. Due to his existing five-year good record the MRP early plea called for a reprimand. Simpson admitted guilt and accepted the MRP reprimand and 70.31 points towards his future record.

ADELAIDE v HAWTHORN
Lance Franklin (Haw) was cited with engaging in rough conduct against Michael Doherty (Ade) in Q2. The incident was assessed as negligent conduct (one point), low impact (one point) and high contact (two points), a total of four activation points drawing a Level One offence and 125 demerit points and a one-match suspension. With no good or bad record against Franklin the MRP early plea offer reduced the penalty to a reprimand and 93.75 points towards his future record. The incident was assessed as reckless conduct (two points), low impact (one point), and high contact (two points), a total of five activation points drawing a Level Two offence, 125 demerit points and a two-match suspension. RICHMOND v CARLTON
Brendan Fevola (Car) was cited for wrestling Kelvin Moore (Rch) in Q3. The MRP imposed a $3000 fine on Fevola for his actions. The player admitted guilt and accepted the MRP fine.

COLLINGWOOD v SYDNEY
Barry Hall (Syd) cited with a Level Two attempting to strike offence against Shane Wakelin (Col) in Q2. Even with an early plea his penalty is increased to a one-game sanction, due to an existing bad record and carry-over demerit points from within the last 12 months.

The incident was assessed as intentional conduct (three points), impact is not applicable (no points) and high contact (two points). This is a total of five activation points, resulting in a classification of a Level Two offence, drawing 80 demerit points and a reprimand. He has an existing bad record of seven matches suspended within the last three years, increasing the penalty by 50 per cent to 120 demerit points and a one-match sanction. Richard Douglas (Ade) was cited for making negligent contact with umpire Stephen McBurney in Q2. Douglas was offered a fine of $1950 with an early plea. The player admitted guilt and accepted the MRP fine.

GEELONG v FREMANTLE
l Dean Solomon (Fre) was charged with striking Cameron Ling (Gee) during Q1.
The incident where Solomon struck the head of Ling with a left elbow was assessed as intentional conduct (three points), severe impact (four points) and high contact (two points). This is a total of nine activation points, and any offence with nine points results in the charge being automatically forwarded to the Tribunal for its determination under MRP guidelines. He has an existing bad record of three matches suspended within the last three years. He also has 32.81 demerit points carried over from within the last 12 months.
The Tribunal heard the evidence on Tuesday and the jury after deliberation found Solomon guilty of the offence. He was suspended for eight premiership matches.
l Ryan Crowley (Fre) was charged with a level-two striking offence against Gary Ablett (Gee) in Q1. Crowley's previous poor record meant his suspension cannot be reduced from a one-game penalty, even with an early plea. The Tribunal heard the evidence on Tuesday night and following deliberation found Crowley not guilty of the charge.

PORT ADELAIDE v NORTH MELB
Daniel Pratt (NM) was charged with a level-two misconduct charge in that he made unreasonable-unnecessary contact to the face of Brett Ebert (PA) in Q3. In summary, his previous poor record and his carry-over points from within the last 12 months means that his two-game sanction cannot be reduced, even with an early plea.
The incident was assessed as reckless conduct (two points), low impact (one point) and high contact (two points). This is a total of five activation points, resulting in a classification of a Level Two offence, drawing 225 demerit points and a two-match sanction. However the Melbourne run-with player, who had no prior record, had the 125 demerit points reduced by 25 per cent and accepted the 93.75 points towards his future record with an early plea. A second charge of striking against Dunn was withdrawn.
Dunn admitted guilt to the first charge and accepted the MRP penalty of a reprimand.

ADELAIDE v CARLTON

Darren Milburn (Gee) was charged with a Level Four offence for engaging in rough conduct against Shane Edwards (Rch) in Q3.
The incident was assessed as reckless conduct (two points), high impact (three points) and high contact (two points). This is a total of seven activation points, resulting in a classification of a Level Four offence, drawing 425 demerit points and a four-match sanction. He has an existing five-year good record, which reduces the penalty by 25 per cent to 318.75 points and a three-match sanction. Geelong sought the adjudication of the Tribunal. On Tuesday, as AFL's rules governing reportable offences do not specify whether contact refers to that between offender and victim, or contact between the victim and another object such as the ground, chairman David Jones deliberated before instructing the jury to use contact between the two players as the relevant factor. This left the jury with no alternative other than to downgrade the offence to a one-match suspension. As a 25 per cent points reduction for his guilty plea, the one-game ban included a further 25 per cent reduction for Milburn's previous clean record.

FREMANTLE v WEST COAST
Jeff Farmer (Fre) was charged with a Level Two striking offence against Mark Nicoski (WC) in Q3.
The incident was assessed as reckless conduct (two points), low impact (one point) and high contact (two points). This is a total of five activation points, resulting in a classification of a Level Two offence, drawing 125 demerit points and a one-match sanction. He has an existing bad record of eight matches suspended within the last three years, increasing the penalty by 50 per cent to 187.50 points and a one-match sanction. On February 6, the AFL announced minor changes to its tribunal procedures for 2006 after a special review.

The changes include:

l
A change in the weighting for prior offences based on concerns that these may be excessive when combined with carry over points. In 2006 players will receive a 10 per cent loading for an offence for each match suspension beyond one match in the previous three AFL seasons. The maximum weighting a player can receive will be capped at 50 per cent.

Last year players received a 10 per cent loading for each one-match suspension, 20 per cent for each two-match suspension and 30 per cent for each suspension of three or more matches.

l Players will no longer be automatically disqualified for a 25 per cent discount for a good record if their only reportable offence in the past five years resulted in a financial penalty. This affects offences such as wrestling, participating in a melee or shaking a goalpost.

l The tribunal jury will be bound by the table of offences when classifying an offence, unless exceptional or compelling circumstances apply. Previously, when the tribunal classified an offence differently from the Match Review Panel, the suspension was left at the discretion of the tribunal.

l The deadline for the acceptance of an early plea has been extended from 10am to 11am on the day after the notification of a charge. This will give clubs extra time to assess an offer from the Match Review Panel, particularly the Western Australian clubs operating under a different time zone.

l Additional categories of misconduct have been added to the table of offences. These are spitting, contact with head – including face – and unreasonable and unnecessary contact with an injured player. This will enable the MRP to classify these offences, providing players with an option to enter an early plea rather than automatically having to face the tribunal.

l The activation points applicable to the location of an offence (either in-play or behind-play) have been changed so no points are added when an offence occurs in-play. Last year two activation points applied to behind-play incidents and one point applied to in-play incidents. Based on feedback, the AFL agreed an extra loading should not be applied to in-play incidents.

l The stated definitions of behind play and the classifications of intentional, reckless or negligent have also been expanded and clarified at the request of AFL clubs.

u The level of a charge is determined by a combination of four factors: conduct
(intentional, reckless or negligent); impact damage to victim (severe, high, medium, low); location (in play, behind play); contact (high, or to the body).

DEFINITIONS

Behind play means not within close proximity to the ball and (a) occurring at any location which could not reasonably be regarded as an option for delivery of the ball, by a person in control of the ball or who is likely to gain control of the ball; and (b) occurring during times when play has stopped, including the breaks between quarters or after the final siren.

The definition of behind play also confirms that incidents will not be regarded as behind play if they occur as part of what could be reasonably regarded as an option for the next passage of play.

Intentional means a deliberate desire to commit a reportable offence. It requires evidence, drawn from observations of a player's behaviour that the player set out to commit a reportable offence.

Reckless differs from intentional in that a player does not need to show a deliberate desire to commit a reportable offence.

Negligent means the failure to take due care to avoid any consequences that could reasonably be foreseen to result in a reportable offence. Negligent is different from intentional and reckless in that it does not require a deliberate desire to commit a reportable offence or a reckless disregard for whether or not the action resulted in a reportable offence.

l The definition of an AFL year has also been amended. The league will look at the relevant round (rather than relevant date) as a fairer way of assessing a player's prior record and determining when carry-over points expire.

l The extent to which clubs and players are permitted to use examples from the 2006 Tribunal DVD and any other cases in the relevant year will be the subject of guidelines to be issued by Tribunal Chairman, David Jones QC.
