PRELIMINARY FINALS
ST KILDA v SYDNEY
Barry Hall
(Syd) was cited by the MRP with a Level 2 offence for striking Matt Maguire (StK) during the first quarter.
The incident was assessed as reckless conduct (two points), low impact (one point), behind play (two points) and body contact (one point). This is a total of six activation points, which relates to a Level Two offence, drawing 225 demerit points and a two-game suspension. He has no applicable good or bad record. An early plea reduces the penalty by 25 per cent to 168.75 points and a one-game suspension. The club took the charge to the AFL Tribunal for adjudication. On Tuesday Hall pleaded guilty to having struck Maguire, but successfully argued that the incident took place "in play" rather than "behind play" downgrading the offence to a Level One striking charge. When combined with a 25 per cent reduction for his early guilty plea, it took the level of points below the 100-point threshold for a suspension. Hall received a reprimand instead.

WEST COAST v ADELAIDE
Travis Gaspar
(WC) was cited by the MRP with a Level Two striking offence against Ken McGregor (Ade), before the first bounce of the second Preliminary Final. The incident was assessed as negligent conduct (one point), low impact (one point), behind play (two points) and high contact (two points). On Tuesday it was successfully argued that Gaspar's actions didn't constitute a strike and that they were purely accidental. Gaspar's version was supported by field umpire Shaun Ryan, who paid a free kick after seeing the clash which resulted in McGregor kicking a goal. The Tribunal dismissed the charge.

TRIBUNAL LESSONS TO LEARN

Paul Gough
afl.com.au

There are several lessons for players and clubs still to learn as a result of the AFL's new tribunal and reporting system.

The first is that no matter how minor an incident might be, any reportable offence committed by a player behind play will be harshly dealt with under the set penalties system.

This is why Collingwood goalsneak Alan Didak copped a two match ban last week for his seemingly innocuous elbow on Port's Daryl Wakelin. The incident was deemed to be behind play.

And under the set penalties system used to determine what level a player's report is graded at, more weight is given to incidents deemed behind play even if the impact of the incident was only deemed to be low.

So the message to players is quite clear - just don't get involved in anything untoward off the ball or pay a heavy price.

The second lesson for players and the clubs is to make sure your player is prepared to cope with the far more intense questioning, if they decide to challenge their penalty at the tribunal, particularly now that the AFL advocates are highly skilled legal professionals who are expert in putting the right questions to players at the hearings.

If a club does not think a particular player will be able to handle himself in that situation, they would be far better advised to accept their set penalty from the match review panel rather than risk copping a higher suspension - as again happened in the Didak case.

Didak was originally offered a one match ban but ended up with two as the Magpies attempts to have the charge downgraded failed.

But one area where the players seemingly do have an advantage under the new system is on the question of intent and the difficulty in proving a player's actions in committing a reportable offence were deliberate.

With intentional being the most serious classification in terms of the players' conduct when grading the charge - the others being reckless and negligient - this means that if a player is found guilty of an intentional action he will receive a higher penalty.

However with the three man jury system made up of ex-players having no way of being able to read a player's mind when it comes to whether they deliberately meant to commit a reportable offence on another player - this appears to be the best area in which clubs can plead to have a player's charge downgraded.

And the final message that appears to have become clear over the first 15 weeks of the new tribunal system is the role of the AFL Appeals Board in the process.

It's quite clear clubs are struggling to understand the role of the appeals board in the new process as it no longer has the power to simply re-hear a case and come up with a different verdict.

With players now being judged by experts at the tribunal - their peers through the ex-players who form the new jury system at the tribunal, the appeal board can hardly be seen to be continually overruling an expert decision considering it is made up of non-experts in that it does not consist of recently retired ex-players.

The appeals board can only overturn a tribunal decision if it finds that no tribunal acting reasonably could have arrived at the decision they did or that the penalty imposed was manifestly excessive for that particular offence.

But considering the jury has consistently imposed the same penalties as laid out in the AFL rules under the new set penalties system - the clubs can hardly argue to the appeals board that the tribunal has been imposing penalties that have been too harsh.

SEMI-FINALS
MATCH REVIEW PANEL

The AFL Match Review Panel has assessed two incidents from the weekend's round of matches, but no charges were laid:

ADELAIDE v PORT ADELAIDE
Contact between Port Adelaide's Byron Pickett and Adelaide's Rhett Biglands from the second quarter of Saturday's match was reviewed. Pickett's action was not deemed to be reportable and no further action was required.

Contact between Port Adelaide's Brett Montgomery and Adelaide's Brett Burton from the second quarter of Saturday's match was reviewed. The panel said Montgomery made a spoiling attempt as Burton went to mark. ELIMINATION & QUALIFYING FINALS
MATCH REVIEW PANEL

CHARGE WITHDRAWN
The match day report laid by
umpire Darren Goldspink against Geelong's Steve Johnson for engaging in rough conduct against Melbourne's Ben Holland was reviewed.

The MRP noted while Johnson made contact with Holland's head, there was only minimal force and his action therefore did not constitute a reportable offence and no further action was required.

CHARGES LAID
:
l Domenic Cassisi (Port Adelaide) cited with a first offence for making negligent contact with umpire Hayden Kennedy during the third quarter of the First Elimination Final between Port Adelaide and the Kangaroos. Cassisi can accept a $2400 fine with an early plea. A first offence for making negligent contact with an umpire is a $3200 fine. An early plea reduces the penalty by 25 per cent to a $2400 fine.

l Leigh Colbert (Kangaroos) cited with wrestling Chad Cornes (Port Adelaide) during the third quarter of the First Elimination Final between the Kangaroos and Port Adelaide. Colbert can accept a $900 fine with an early plea. A first offence for wrestling is a $1200 fine. An early plea reduces the penalty by 25 per cent to a $900 fine.

l Glenn Archer (Kangaroos) cited with wrestling Chad Cornes (Port Adelaide) during the third quarter of the First Elimination Final between the Kangaroos and Port Adelaide. Archer can accept a $900 fine with an early plea. A first offence for wrestling is a $1200 fine. An early plea reduces the penalty by 25 per cent to a $900 fine.

l Drew Petrie (Kangaroos) cited with wrestling Peter Burgoyne (Port Adelaide) during the third quarter of the First Elimination Final between the Kangaroos and Port Adelaide. Petrie can accept a $900 fine with an early plea. A first offence for wrestling is a $1200 fine. An early plea reduces the penalty by 25 per cent to a $900 fine.

OTHER INCIDENTS ASSESSED: NO CHARGE LAID:
l Contact between Daniel Chick (West Coast) and Michael O'Loughlin (Sydney) from the second quarter of Friday's match was reviewed. The panel said both players grappled with each other. Chick grabbed O'Loughlin's jumper and pulled and then pushed him. While contact was made to O'Loughlin, Chick's action was seen as a pushing motion, rather than a striking action. No further action was required.

l Contact between Steven King (Geelong) and Jeff White (Melbourne) from the third quarter of Saturday's match was reviewed. The panel said King and White contested a boundary throw-in, with White positioned behind King's left shoulder. The ball fell towards the right side of King and, as the ball was dropping and the area was clear, he swung his right foot to kick the ball as it fell. At the same time, White moved towards the ball to hit it with his left hand. King missed the ball and his right lower leg made contact with White's face in the follow-through. At no stage was King looking anywhere but at the ball. Despite the terrible injuries suffered by White, the contact made by King was accidental and therefore was not a reportable offence. No further action was required.

l Contact between Glenn Archer (Kangaroos) and Warren Tredrea (Port Adelaide) from the first quarter of Sunday's match was reviewed. The panel said Archer swung his right arm towards Tredrea as Tredrea bumped him. The force involved in Archer's action was deemed to be below the level required to constitute a reportable offence.

For charges laid by the Match Review Panel, clubs and players have until 10am (EST), Tuesday September 6, to decide whether to accept the penalty allocated, or to contest the case.

For charges laid by the Match Review Panel, clubs and players have until 10am (EST), Tuesday August 30, to decide whether to accept the penalty allocated, or to contest the case.
